Terms & Conditions

We are pleased that you are interested in a trip with us and thank you for your trust. To book your trip, we send you a registration form detailing the trip, the prices and the cancellation policy, which you must return signed (by email). The booking of the trip implies that you have read our terms and conditions of sale. 

1. Finalization of the travel contract

 

  • With the booking (travel registration), the customer agrees to the binding finalization of the travel contract.
  • The booking can be made by phone, in writing, by fax or electronically (e-mail, internet). Written or faxed bookings should be made with the booking form provided by the travel agent.
  • The contract is finalized with the receipt of the booking confirmation from the travel agent by the customer. A specific form is not required. At or immediately after the finalization of the contract, the travel agent will send the customer a written travel confirmation. The travel agent is not obliged to do so if the booking by the customer is made less than 7 business days before the start of the tour.
  • The contractual obligations of the travel agent to perform are determined by the tour description in conjunction with the booking confirmation and all supplementary information by the travel agent for the respective trip.

2. Prices and terms of payment

 

  • The travel price to be paid by you can be seen in the travel advertisement. Unless otherwise stated, prices are per person for accommodation in a double room.
  • The specified minimum group size is required. If the trip is carried out with fewer participants, the published small group surcharge applies. 
  • Where no small group surcharge is advertised, you will be informed of the amount of the surcharge in good time and then have the right to withdraw from the contract free of charge within 7 days of receipt of our notification.
  • The customer can make the payment by credit card or bank transfer.
  • In the following cases, we reserve the right to increase the prices published and confirmed by us:
    • Increase in transport costs (e.g. fuel surcharges)
    • newly introduced or increased taxes or fees 
    • state-imposed price increases (e.g. VAT)
    • Exchange rates
    • Explainable printing errors
    • Noble Explorer will announce price increases due to the above-mentioned reasons no later than 21 days before departure. If the price increase amounts to more than 10% of the advertised package price or, in the case of trips with individual prices, the total package price, you have the right to withdraw from the contract free of charge within 5 days of receipt of our notification

3. Services

 

  • The travel agent expressly reserves the right to declare a change of the brochure information for factually justified, significant and unforeseeable reasons before the finalization of the contract, about which the customer will be informed before the booking.
  • Third parties are not authorized to make promises and / or agreements that deviate from the travel conditions or the travel agent’s advertisements.
  • Services that are booked directly by the customer with third-party companies as external services are not part of the travel agent’s scope of services (e.g. sightseeing, transfers, excursions, tours, exhibitions, etc).

4. Cancellation by the customer before the start of the trip

 

  • Compensation is calculated according to the date of receipt of the customer’s cancellation notice and the percentage of the tour price as follows, unless otherwise stated in the offer: 
    •  until the 30th day before departure = 20%
    • from the 29th to the 22nd day before departure = 40%
    • from the 21st to the 15th day before departure = 60%
    • from the 14th to the 7th day before departure = 70%
    • from the 6th to the last day before departure = 90%
    • on the day of departure or in case of no-show = 100%

5. Re-Bookings

 

  • If you have to interrupt your trip for any reason or want to change services during the trip, you are not entitled to a refund. Our tour guide or local representative will assist you as much as possible in urgent cases (illness or accident, serious illness or death of relatives, etc.) in organizing your return journey or change. In this context, please also note the assistance and conditions provided by your travel insurance. In case of interruption of the trip or change of the travel services, the (additional) costs will have to be covered by you. 
  • In the case of an interruption of travel, we also reserve the right to change individual agreed services or itineraries in your interest before or during the trip if unforeseen circumstances require this. In rare cases, it may also be necessary to cancel a trip or break it off prematurely. Circumstances of this kind include strikes, official measures or force majeure (e.g. natural disasters, epidemics, unrest, acts of war, etc.) or other circumstances that make the journey impossible, considerably more difficult or entail a considerable danger to the participants.

6. Re-Bookings

 

  • After finalization of the contract, the customer has no right to change the date of travel, the destination, the location, the start of travel, the accommodation or the mode of transport (re-booking). If a re-booking is possible and is nevertheless made at the request of the customer, the customer will have to cover the additional costs incurred.

7. Cancellation by the travel agent

 

  • If the minimum number of participants, which is explicitly stated in the respective travel offer, is not reached, the travel agent is entitled to:
    •  Cancel the trip up to 20 days before the start of the trip. The paid travel price will be refunded to the customer immediately. Further claims will not arise.
    • The trip can be carried out against a surcharge despite the not adhered to minimum number of participants. The amount of the surcharge will be communicated to the customer separately.
  • The travel agent is entitled to withdraw from the travel contract or to cancel it after the start of the trip if:
    • The participant(s) persistently disturb(s) the program in spite of a reminder or behave(s) in such a way contrary to the contract that the immediate cancellation of the contract is justified. Any costs incurred will have to be covered in full by the participant(s).
    • Due to force majeure or other circumstances beyond our control, the trip is impaired or cannot be carried out.

8. Substitute travelers

 

  • A traveler can be replaced by a third party until the start of the trip, provided that the third party meets the special travel requirements and their participation is not contrary to legal regulations or official orders, and the travel agent does not object to the participation for these reasons.
  • The traveler and the third party are liable to the organizer as joint debtors for the travel price and for the additional costs incurred by the participation of the third party.

9. Flights

 

  • The total amount of airline tickets and fees must be paid during the confirmation of the trip (if you have asked for this option) and the cancellation policy will depend on the airline company conditions.
  • The travel agent is not liable for flight delays, flight cancellations and loss or damage of luggage.

10. Insurance

 

  • Noble Explorer has taken out professional liability insurance with AXA ASSURANCE MAROC (registered number 380 2015 3 01370).
  • This does not replace the guarantees that each traveler must subscribe individually.
  • Booking with us implies that you have comprehensive insurance: Trip cancellation insurance, baggage insurance, trip interruption, accidents, natural disasters, repatriation.
  • Having a copy of your insurance policy will allow us at any time to get in touch with your insurer if necessary.

11. Liability

 

  • The travel agent is liable within the scope of due diligence for:
    •  A conscientious travel preparation
    • A careful selection and monitoring of the service providers
    • The accuracy of the service description and for the proper provision of the specified travel services
  • Noble Explorer can not be held liable for the consequences of the following events:
    •  Failure to present or presentation of identity and / or sanitary documents that are out of the expiry date or insufficiently valid (identity card, passport, visas, vaccination certificate, etc.) In case of registration failure (including late boarding), 100% of the total amount of the trip will be retained as a fee.
    • Non-compliance with regulations and police and health formalities.
    • Incidents or unforeseeable and insurmountable events of a third party unrelated to Noble Explorer such as: wars, political unrest, strikes, inclement weather, delays , breakdowns, loss or theft of luggage or other effects.
    • The delay(s) that result from the cases mentioned above, as well as the itinerary modifications that may result from it, will not result in any compensation, especially as a result of the modification of the duration of the program initially planned or a flight connection delay. Any additional costs related to a disruption (tax, hotel, parking, …) will remain the responsibility of the customer.
    • Cancellation due to unpredictable events (force majeure) and / or for reasons related to the safety of customers and / or on the orders of an administrative authority. Noble Explorer reserves the right to change the dates, times or routes provided in case your security could not be ensured.
    • Given the off-the-beaten-track and adventurous nature of our trips, each participant must be aware of the risks they may run, especially due to the remoteness of medical centers. Each participant assumes these risks with full knowledge and undertakes not to make Noble Explorer, the guides or the different service providers responsible for any accidents that may occur.
    • Each participant must comply with the rules of caution and follow the advice given by the guide and / or the driver. Noble Explorer can not be held responsible for accidents that are due to individual imprudence of a member of the group.
    • The service providers to whom Noble Explorer can call on for the creation and implementation of their stays have their own responsibility and insurance. Noble Explorer can not be confused with these same providers.
    • Noble Explorer declines any responsibility in case of theft, loss or deterioration of your luggage and personal effects that may occur during your trip.
    • Noble Explorer can not replace the individual responsibility of any participant.
